Das neue Pfandbriefgesetz (englische Fassung: The new German Pfandbrief Act)

With the German Act on the Reorganisation of Pfandbrief Legislation (Gesetz zur Neuordnung des Pfandbriefrechts), which will enter into force on 19th July, 2005, the necessary steps have been taken to further improve the regulatory framework for this product of the financial centre of Germany in a uniform manner for all credit institutions and to further increase the already high acceptance of the German Pfandbrief. Its centrepiece is the new German Pfandbrief Act (PfandBG). The Association of German Public Sector Banks (VÖB) and Allen & Overy consider the new Act, taken as a whole, as an enormous success. It will significantly contribute to strengthening Germany as a financial centre, and the banks doing business there, in a competitive environment that has become increasingly challenging at both a European and an international level.

With the new Pfandbrief legislation, the Federal Parliament and the Federal Council have succeeded in launching and realising a particularly important project in record time. The project could be based on the existing legislation and the very good preliminary work of the Federal Ministry of Finance. This brochure summarises the main features of the new Pfandbrief Act and its effects. It is supplemented by an extensive collection of materials regarding the legislative project.
